The Board of Directors of the Santiago Arbitration and Mediation Centre is the governing body of the CAM Santiago.
In accordance with article 3 of the Statutes of the Santiago Arbitration and Mediation Centre (effective as of 17 October 2019) the CAM Santiago Board of Directors is comprised by 15 members, appointed by the Board of Directors of the Santiago Chamber of Commerce A.G. (CCS). The Past-President will also be part of the Council with full rights.
Within the functions of the CAM Santiago Board of Directors are the preparation, maintenance and updating of the lists of domestic arbitrators and mediators, as well as the appointment of these in the cases administered by the CAM Santiago.
The appointment of domestic arbitrators and mediators is made by selecting those individuals who are members of our lists when the parties have delegated such power to the Santiago Chamber of Commerce A.G.
Regarding international commercial arbitration cases, the CAM Santiago does not have a list of arbitrators, and it is the duty of the Board of Directors in each appointment to take into account the elements involved in each case, such as the nationality of the parties, the applicable laws, the seat of the arbitration and the languages involved in the dispute (article 11 of the CAM Santiago Statutes).
The Members of the Board of Directors are arbitrators, but they can only be appointed as such in case they are directly appointed by the parties.
